Terms of Service

These Terms of Service ("Terms") govern your use of icebatu.com and the membership services provided by Third Space Wellness Sdn. Bhd. (Company Registration No. 202601004222 (1666319-T)), trading as Icebatu.

By creating an account, paying a reservation deposit, or becoming a member, you agree to these Terms.

Section 1: Definitions

• "Icebatu" means the contrast therapy social club operated by Third Space Wellness Sdn. Bhd. at our premises in Adda Heights, Johor Bahru.
• "Member" means any person who has paid for an active reservation deposit or membership.
• "Founding Member" means one of the first 100 members who paid the founding reservation deposit.
• "Premises" means the physical Icebatu location.
• "Services" means access to facilities, classes, retreats, and any related offering.

Section 2: Eligibility

To become a member you must:

• Be at least 18 years of age
• Be capable of entering into a legally binding agreement under Malaysian law
• Provide accurate, current, and complete information at signup
• Not have any medical condition that contraindicates cold water immersion or sauna use without medical clearance (see Section 8)

Section 3: Membership tiers and pricing

• Founding Member — RM 249/month, locked at this rate for life. Limited to the first 100 reservations. Requires a RM 100 reservation deposit. Applied as credit to first month's membership upon opening.
• Standard Member — RM 349/month. Available after opening.
• Sanctuary Member — RM 299/month, women-only zone access. Available after opening.
• Drop-in — RM 99 per 90-minute session.
• Trial — RM 99 for 14 days, unlimited access (capped at 5 visits).

Pricing is in Malaysian Ringgit (RM) and inclusive of applicable taxes unless otherwise stated. We may revise pricing for new memberships at any time, but existing members' rates are honored according to their tier terms.

Section 4: Founding Member Reservation

• You pay RM 100 deposit to reserve your founding spot
• Your spot is held for you until we open
• On opening day, your RM 100 deposit is applied as credit to your first month (first invoice = RM 149)
• From your second month onwards, you are billed RM 249/month
• Your founding rate of RM 249/month is locked for as long as you maintain continuous active membership
• If you cancel your founding membership at any time after opening day, you forfeit your founding rate permanently and may only rejoin at the then-current Standard pricing

Section 5: Account and security

You are responsible for:

• Maintaining the confidentiality of your account access (we use passwordless magic link authentication)
• All activity that occurs under your account
• Notifying us immediately of any unauthorized access at icebatu.official@gmail.com

We reserve the right to suspend or terminate accounts that show signs of fraud, abuse, or violation of these Terms.

Section 6: Use of facilities

When using our premises, you agree to:

• Follow all posted rules and staff instructions
• Maintain appropriate hygiene (shower before entering plunges, no street shoes in wet zones)
• Respect other members' privacy (no photography in changing or wet zones, no recording in the women-only Sanctuary)
• Not enter the premises under the influence of alcohol or drugs
• Not bring weapons, illegal substances, or any item that could pose a safety risk
• Report any safety concerns or equipment issues to staff immediately

We reserve the right to refuse service or remove anyone from the premises for violation of these rules.

Section 7: Bookings and cancellations

Sessions in the women-only Sanctuary and multifunction classes require advance booking. Public-side sessions are walk-in only.

• Bookings may be made up to 7 days in advance
• Cancellations must be made at least 4 hours before your booked slot
• Late cancellations or no-shows may result in temporary booking restrictions for repeat offenders

Section 8: Health, safety, and liability

Important: contrast therapy involves real medical risks. By using our facilities, you confirm and agree to the following:

• You are in good general health and have no medical condition that would make cold water immersion (ice baths) or sauna use unsafe for you
• You have consulted a doctor if you have any of the following: heart disease, high blood pressure, diabetes, epilepsy, recent surgery, pregnancy, or any condition affecting circulation or temperature regulation
• You will not use our facilities while intoxicated, dehydrated, or while taking medications that affect blood pressure, heart rate, or perception
• You assume the inherent risks of contrast therapy, including but not limited to: cold shock response, hyperventilation, dizziness, fainting, cardiac events, and slip/fall injuries on wet surfaces
• You will sign a separate Liability Waiver before your first visit, which forms part of these Terms

To the maximum extent permitted by Malaysian law, you release Third Space Wellness Sdn. Bhd., its directors, employees, and agents from all liability for injury, loss, or damage arising from your use of our facilities, except where caused by our gross negligence or willful misconduct.

Section 9: Intellectual property

All content on icebatu.com — including text, images, logos, design, and software — is owned by Third Space Wellness Sdn. Bhd. or our licensors. You may not reproduce, distribute, or create derivative works without our written permission.

The "Icebatu" name, logo, and brand are trademarks of Third Space Wellness Sdn. Bhd.

Section 10: Communications and marketing

By becoming a member you consent to receive:

• Transactional emails about your account (login links, payment confirmations, cancellations)
• Service-related communications (renovation updates, opening announcements, schedule changes)

For marketing communications (newsletters, promotions, new retreat announcements), we will obtain your explicit consent and you can withdraw it at any time via the unsubscribe link or by emailing icebatu.official@gmail.com.

Section 11: Force majeure

We are not liable for any failure or delay in providing services due to events outside our reasonable control, including: natural disasters, government actions, public health emergencies, utility failures, fire, flood, or any cause that prevents us from operating safely. In such cases, we will make reasonable efforts to resume services and to fairly compensate affected members where appropriate.

Section 12: Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated via email to active members at least 30 days before they take effect. Continued use of our services after the effective date constitutes acceptance of the updated Terms.

If you do not agree to changes, you may cancel your membership in accordance with our Refund & Cancellation Policy.

Section 13: Termination

We may terminate or suspend your membership immediately, without prior notice, for:

• Violation of these Terms
• Behavior that endangers staff, other members, or the integrity of our community
• Failure to pay membership fees
• Provision of false or misleading information

You may cancel your membership at any time in accordance with our Refund & Cancellation Policy.

Section 14: Governing law and dispute resolution

These Terms are governed by the laws of Malaysia. Any dispute arising from these Terms or your membership shall be resolved through good-faith negotiation. If that fails, disputes shall be subject to the exclusive jurisdiction of the courts of Johor Bahru, Johor, Malaysia.
